These Terms of Service ("Terms") are a legal agreement between you ("you," "your," or "Customer") and WEDO AKTSA LLC, a Florida limited liability company with its principal address at 4709 Pershoie Lane, Kissimmee, FL 34746, United States ("WEDO," "we," "us," or "our"). They govern your access to and use of the WEDO application, websites at the-wedo.com and app.the-wedo.com, and all related services (together, the "Service").
By creating an account, starting a free trial, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1.Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for business use by painting contractors and their teams, and is currently offered to customers in the United States. By using the Service, you represent that you meet these requirements and that any information you provide is accurate.
2.Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly at suporte@the-wedo.com of any unauthorized use. You may not share your account, and you are responsible for any users you invite to your workspace.
3.The Service
WEDO is an all-in-one platform for painting contractors that may include AI-assisted estimates, a color visualizer, invoices and bookkeeping, contracts and e-signature, scheduling, crews and payroll, client management, inventory, an AI email assistant, portfolio tools, and related features. We may add, change, or remove features over time to improve the Service.
4.Subscriptions, pricing and billing
- Free trial. New accounts include a 15-day free trial. You will not be charged during the trial and may cancel at any time before it ends.
- Price. After the trial, the Service is billed as a monthly subscription. A founder price of $19.99/month is offered to the first 50 subscribers; the standard price thereafter is $39.99/month. Prices are in U.S. dollars and exclude any applicable taxes.
- Renewal. Subscriptions renew automatically each month until cancelled.
- Cancellation. You may cancel at any time from within the app. When you cancel, you keep access until the end of the period you have already paid for.
- No refunds. Payments already made are non-refundable, except where required by law. Cancelling stops future charges; it does not refund the current period.
- Payments. Payments are processed by a third-party payment processor. We do not store your full card number. Your use of payment features is also subject to the processor's terms.
- Price changes. We may change subscription prices with reasonable advance notice; changes apply to the next billing cycle after the notice.
5.AI-assisted features
Some features use artificial intelligence to help you draft estimates, messages, designs, and similar content. AI output is a starting point, not professional advice, and may contain errors or inaccuracies. You are responsible for reviewing, correcting, and approving any estimate, price, contract, or message before you rely on it or send it to a client. WEDO is not liable for decisions you make based on AI-generated output.
6.Your content and data
You retain all rights to the information and materials you and your clients put into the Service, including client records, estimates, photos, and documents ("Customer Content"). You grant WEDO a limited license to host, process, and display Customer Content solely to provide and improve the Service for you. You are responsible for having the necessary rights and consents for any Customer Content you upload, including client information and photos.
7.Acceptable use
You agree not to: (a) use the Service for any unlawful, fraudulent, or abusive purpose; (b) upload content that infringes others' rights or that you have no right to use; (c) attempt to gain unauthorized access to the Service, other accounts, or our systems; (d) interfere with or disrupt the Service; (e) reverse engineer, resell, or copy the Service except as allowed by law; or (f) use the Service to send spam or unlawful communications.
8.Intellectual property
The Service, including its software, design, branding, and the WEDO and AKTSA names and logos, is owned by WEDO AKTSA LLC and protected by intellectual property laws. These Terms do not grant you any right in our intellectual property except the limited right to use the Service as described here.
9.Third-party services
The Service relies on trusted third-party providers for hosting, authentication, AI processing, and email delivery. Their handling of data is described in our Privacy Policy. We are not responsible for third-party services we do not control.
10.Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate. You use the Service at your own risk.
11.Limitation of liability
To the maximum extent permitted by law, WEDO AKTSA LLC and its owners and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.
12.Indemnification
You agree to indemnify and hold harmless WEDO AKTSA LLC from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your Customer Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
13.Termination
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could harm us, other users, or third parties. Upon termination, your right to use the Service ends; sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.
14.Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
15.Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute arising from these Terms or the Service, unless otherwise required by applicable law.
